Welcome to Demons Kickboxing (“The Den, the Gym”, “we”, “our”, “us”).
These Terms and Conditions (“Terms”) govern your membership, training, and participation in all classes, programs, and events provided by Demons Kickboxing. By signing up, entering our premises, or participating in any activity, you agree to comply with and be bound by these Terms.

1. Membership and Access
1.1. Eligibility: Members must be at least 16 years old unless approved in writing by Demons Kickboxing and accompanied by a parent or legal guardian.
1.2. Membership Types: Details of membership options, durations, and fees are available at the front desk, on our website, or via ClubRight. We reserve the right to update membership fees with reasonable notice.
1.3. Access Rights: Membership grants access during official operating hours and for the activities included in your membership plan.
1.4. Non-Transferable: Memberships and passes are strictly personal and cannot be transferred, shared, or sold.
1.5. Booking Classes: All classes and sessions must be booked through ClubRight. Attendance is only guaranteed if the booking is confirmed.

2. Payments, Renewals and Amendments
2.1. Payment Terms: Membership and class fees must be paid in full and in advance via ClubRight or via the till at the front desk.
2.2. Auto-Renewal: Unless cancelled under Section 3, memberships may automatically renew at the current rate through ClubRight.
2.3. Late Payments: The Gym reserves the right to freeze or terminate memberships if payments are missed, declined, or remain overdue. Access to classes and facilities will be restricted until all outstanding balances are settled.
2.4. Price Adjustments: Membership and class fees are subject to change with at least 30 days’ notice to current members.
2.5. Amendments: Changes to Direct Debit arrangements must be made no later than five (5) working days before the 1st of the month. Changes made after this time may not be applied until the following billing cycle, and any payment already in process will not be refunded.

3. Cancellation and Refunds
3.1. Member Cancellations: Membership cancellations must be submitted through ClubRight or in writing at least 30 days before the next billing cycle.
3.2. Class Cancellations: Classes booked through ClubRight must be cancelled at least 6 hours before the session to avoid forfeiting the booking.
3.3. No Refunds: Fees are non-refundable, including for non-attendance or unused portions of a membership, except where required by law.
3.4. Medical or Relocation Exceptions: Memberships may be frozen or cancelled in special circumstances (e.g., serious injury, illness, or relocation) with written proof.
3.5. Termination by the Gym: Demons Kickboxing reserves the right to cancel any membership at any time for breach of these Terms or for behaviour deemed unsafe or inappropriate.

4. Health and Safety
4.1. Medical Clearance: Members must ensure they are medically fit to participate in kickboxing and related activities. Consult your doctor before starting any training program.
4.2. Injury or Illness: You must inform staff immediately if you experience any injury, illness, or medical condition that may affect your participation.
4.3. Safety Rules: All members must follow trainer instructions and use protective gear (gloves, wraps, mouthguards, etc.) during sessions.
4.4. Cleanliness: Members must maintain personal hygiene and clean all equipment after use.
4.5. Drugs and Alcohol: Possession or use of alcohol, drugs, or illegal substances on the premises is strictly prohibited.

5. Liability and Waiver
5.1. Assumption of Risk: You acknowledge that kickboxing and combat training involve physical exertion and inherent risks, including injury or death. Participation is entirely at your own risk.
5.2. Release of Liability: To the maximum extent permitted by law, Demons Kickboxing, its owners, trainers, employees, and agents shall not be held liable for any injury, accident, property damage, or loss arising from your participation.
5.3. Personal Property: The Gym is not responsible for lost, stolen, or damaged belongings.
5.4. Insurance: Members are encouraged to maintain their own personal health and accident insurance.

6. Code of Conduct
6.1. Respect: Members must behave respectfully toward staff, instructors, and fellow members. Any form of harassment, discrimination, or aggression will result in immediate suspension or termination.
6.2. Equipment Care: Members must use all equipment properly and may be held financially responsible for any intentional damage.
6.3. Dress Code: Appropriate training attire and no footwear must be worn at all times.
6.4. Discipline: Trainers and staff have the authority to remove anyone whose conduct compromises safety or disrupts others.

7. Classes and Scheduling
7.1. Timetables: Class schedules, instructors, and formats may change without notice.
7.2. Cancellations: The Gym reserves the right to cancel or reschedule classes due to instructor unavailability, maintenance, or low attendance.
7.3. Punctuality: Late arrivals may be denied entry to avoid disrupting ongoing classes.
7.4. Booking Platform: All class bookings, cancellations, and attendance are managed via ClubRight. Members are responsible for ensuring bookings are made and confirmed through the platform.

8. Photography and Media
8.1. Promotional Use: By attending classes or events, you consent to the use of photographs or video footage featuring you for promotional and marketing purposes by Demons Kickboxing.
8.2. Opt-Out: Members may request in writing not to appear in promotional media.
8.3. Personal Filming: Recording or photographing other members or classes without permission is not allowed.

9. Privacy Policy
Your personal data, including that collected via ClubRight, will be handled in accordance with applicable data protection laws and our Privacy Policy, available upon request or via our website.

10. Amendments
Demons Kickboxing may modify these Terms at any time. Updated Terms will be posted on our website, in ClubRight, or displayed in the Gym. Continued participation after updates constitutes acceptance of the revised Terms.

11. Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Kent, England.
